AGREEMENT FOR A MUSIC SHOW AND PERFORMANCE

THIS AGREEMENT is made this …. day of ………………., 2011

BETWEEN

…………….of P.O Box…………., Tanzania (hereinafter to be known as “Organizer”) of one party

AND

…………………of P.O Box ……………(hereinafter to be known as “the Promoter”) of the other Party.

 

WHEREAS the Organizer is a limited liability company based in Dar es Salaam and dealing in promotions and advertisements business.

 

WHEREAS the Promoter is a firm based in Tanzania also dealing in promotions and it is presently the promoter of ………………………..(hereinafter referred to as “the Group”).

 

AND WHEREAS the Organizer is desirous of organizing the coming of……………. for shows and performances within Tanzania.

 

AND WHEREAS the Promoter upon being requested has agreed to arrange for the coming and perform of the …………….Groups, on……….  2011 at……………., and at………….on……… 2011 respectively and provide the show and performance on terms and conditions hereinafter appearing.

 

NOW THIS AGREEMENT WITNESSETH AS FOLLOWS:-

 

1.      That the Organizer shall undertake to be responsible for transportation by Airplane of the (musician) ….. from …………….to………………, Tanzania, including procurement of Visa and work permits.

2.      That the Organizer shall be responsible for arrangement and payment of accommodation and local transport for the Group, and in particular the Organizer shall be obliged to secure rooms in any Three Star Hotels for the group leaders and a medium hotel for the other musicians. Provided that payment for such accommodation shall also cover expenses for breakfast, lunch, dinner and incidentals thereto.

 

3.      That the Organizer shall undertake to pay the Promoter US$ 3,000 (Three Thousand US Dollars) for three shows made and arrange and pay for the hiring of suitable Vehicles for the group leaders and the group musicians, halls expenses, and medical cost, which vehicles shall be used by the Group throughout their stay in Tanzania.

 

4.      That the Organizer shall take care and be responsible for payment of rates, taxes, duties, dues, assessments hereinafter to be payable to the Government of Tanzania or any other local or public authority.

5.      That the Organizer shall be obliged to avail the Promoter excellent musical instruments which the Group will be using during and for musical performance while in Tanzania.

6.      That the Organizer shall have exclusive rights for entrance fees, collection, advertisements, media coverage and related matters.

7.      That the Organizer shall undertake to secure all licenses, approvals and permits for conducting the said shows.

8.      The parties hereto agree to be bound by the terms of this Agreement and subject themselves to the laws and jurisdiction of the Courts in Tanzania.

9.      Neither of the parties hereto shall be demanded to be in default or in breach of this Agreement in case of Force Majeure or for other reasons beyond their control. Without prejudice to the generality of the foregoing, such causes or reasons shall include Acts of God or of the public enemy, Acts of State, War, Armed conflict, riot, Civil commotion, explosion, strike, lock-out, stoppage of work or other similar cause.
